What is FERPA?

The Family Educational Rights and Privacy Act (FERPA) is a federal law that protects the privacy of student education records. It applies to all schools that receive federal funding and gives parents (and eligible students over 18) rights to:

  • Inspect and review their child's education records
  • Request corrections to inaccurate records
  • Control disclosure of personally identifiable information (PII)
  • File complaints with the U.S. Department of Education

AcumenEd operates under the 'school official' exception, meaning we can access education records without parental consent when providing services on behalf of the school.

Legitimate Educational Interest

We access only the data necessary to perform our contracted analytics services. Access is limited to the specific functions schools need.

Direct School Control

Schools maintain control over their data. They determine who has access, what data is shared, and can request data deletion at any time.

No Re-disclosure

We never share education records with third parties except as specifically authorized by the school or required by law.

School Responsibilities

While AcumenEd maintains FERPA compliance for our platform, schools retain certain responsibilities:

  • Vendor Designation: Schools must properly designate AcumenEd as a school official in their annual FERPA notification.
  • Access Control: Schools must manage user accounts and ensure only authorized personnel have access to student data.
  • Data Accuracy: Schools are responsible for the accuracy of data uploaded to AcumenEd.
  • Parent Requests: Schools must handle parent requests to inspect or amend education records.
