Terms of Service

These terms govern your use of AcumenEd's charter school analytics platform. By using our services, you agree to these terms.

Agreement to Terms

By accessing or using AcumenEd's charter school analytics platform (“Service”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization (such as a school or district), you represent that you have authority to bind that organization to these Terms.

Description of Service

AcumenEd provides data analytics, reporting, and insights tools designed for Michigan charter schools. Our Service includes:

  • Student growth percentile calculations (SCGP)
  • Early warning systems for attendance, behavior, and course performance
  • Cohort analysis and value-add reporting
  • State accountability monitoring (CSI/TSI)
  • Data visualization and reporting dashboards
Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Accept responsibility for all activities under your account
Subscription & Payment

Billing

Annual subscriptions are billed at the start of the subscription period. Monthly subscriptions are billed on the same date each month. All fees are non-refundable except as required by law.

Free Trial

We offer a 30-day free trial. No credit card is required to start.

Acceptable Use Policy

You agree NOT to engage in any of the following prohibited activities:

Use the Service for any unlawful purpose
Access student data you are not authorized to view
Share login credentials with unauthorized users
Attempt to reverse engineer, decompile, or extract source code
Interfere with or disrupt the Service's infrastructure
Use automated tools to scrape or extract data
Resell or redistribute the Service without authorization

Data Ownership

Your Data

Schools retain ownership of all student data and education records uploaded to AcumenEd. We process this data solely on your behalf and in accordance with our Privacy Policy and applicable data protection laws including FERPA.

Our Service

AcumenEd and its licensors own all rights to the Service, including software, algorithms, designs, documentation, and trademarks. You receive a limited, non-exclusive license to use the Service during your subscription.

FERPA Compliance

AcumenEd acts as a “school official” under FERPA and agrees to:

  • Use education records only for authorized purposes
  • Not disclose records except as permitted by FERPA
  • Maintain appropriate security safeguards
  • Return or destroy records upon contract termination

Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. We may temporarily suspend the Service for:

  • Scheduled maintenance (with advance notice when possible)
  • Emergency security updates
  • Circumstances beyond our reasonable control

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACUMENED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from these Terms or the Service shall not exceed the fees you paid in the twelve months preceding the claim.

Termination

By You

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

By Us

We may suspend or terminate your access for violation of these Terms or non-payment. We will provide notice when practicable.

Effect of Termination

Upon termination, your access to the Service will cease. We will retain your data for 90 days to allow for export, after which it will be securely deleted unless legally required to retain it.

Dispute Resolution

Any disputes arising from these Terms shall be governed by the laws of the State of Michigan. You agree to attempt good-faith negotiation before pursuing formal legal action.

Changes to Terms

We may update these Terms periodically. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
